Welcome to the Cone Creator Brand Ambassador Program ("Program").

By participating in this Program, you ("Ambassador") agree to abide by ​the following Terms and Conditions.

Effective Date: 09/05/2024

1. Eligibility

Ambassadors must be at least 18 years of age and residents of the United States. By applying to become a Cone Creator, you ​affirm that you meet these eligibility criteria.

2. Program Requirements

• Ambassadors are required to post one piece of content per week.
  
• The content must be in the form of a video or reel of at least 10 seconds in length.
  
• The video must feature the Ambassador at a Crispy Cones location, visibly eating or enjoying a Crispy Cones product.
  
• Content may be posted on either TikTok or Instagram under the Ambassador’s public account.
  
• The content must follow community guidelines and be respectful, appropriate, and in alignment with Crispy Cones’ brand ​values.
  

3. Content Usage: By participating in the Program, Ambassadors grant Crispy Cones the right to:

• Repost, share, and use the content generated (User-Generated Content, or "UGC") for additional marketing and promotional ​purposes across all Crispy Cones marketing channels, including but not limited to social media, email marketing, and website ​content.
  
• Crispy Cones reserves the right to edit, crop, or modify UGC as necessary.
  

4. Payment & Tiers

• Ambassadors will be assigned to a payment tier based on criteria set forth by Crispy Cones, which may include follower count, ​engagement rates, or other factors. Platinum, Diamond, and Elite tiers are exclusive and approved based on content ​engagement (likes, comments, shares, etc.) If a Creator’s follower count matches the Platinum, Diamond, or Elite tiers but does ​not meet engagement requirements, they will be placed under a lower tier.
  
• Ambassadors will be paid weekly, with payments issued after confirming the required post has been made.
  
• Payments will be processed via the method specified by in the application form.
  

5. Content Standards

All content must adhere to the following standards:

• Must visibly feature the Ambassador enjoying Crispy Cones products.
  
• Must be posted publicly on either TikTok or Instagram, using the appropriate tags and hashtags provided by Crispy Cones.
  
• Content must not feature any inappropriate, offensive, or harmful material.
  

6. Termination of Agreement

Crispy Cones reserves the right to terminate the participation of any Ambassador in the Program at any time for any reason ​including if the creator fails to meet the required content obligations, violates the content standards, or breaches any other term ​of this agreement.

7. Program Affiliation

This Program is in no way sponsored, endorsed, or administered by, or associated with, TikTok or Instagram.

8. Modification of Terms

Crispy Cones reserves the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will ​be effective immediately upon posting.
